Financial Elder Abuse Summary

The law recognizes that people who are 65 years of age and older can become the subject of financial abuse; the abuse may take a number of forms: 

  • A health care provider obtains compensation or property in eccess of  the value of services rendered;
  • A relative, friend or advisor takes unfair use of their position to obtain property or things of value that are not in keeping with the relationship;
  • An institution obtains donations of assets that compromise the donor's ability to maintain his/her own life style, or in contradiction to other professed desires of the donor.

The law provides for significant penalties when it is found that a senior citizen has been the victim of such abuse.
